If you look often enough at the Daas Torah Blog you get a pretty good picture of what most of the visitors as well as the blog host are coming from; they are all halachic sociopaths. The host has the same position on these things as his brother. The only difference being that he is more capable of being civil as apposed to his brother who acts like an animal.<br /><br />He considers it a legitimate thing to withhold a Get if the halacha allows it. I understand that you are disputing that point but Garnel is right that this would be irrelevant from a moral perspective. Daas <br />torah would respond that as long as I cannot find a <br />chapter and verse prohibiting it, that would make it legitimate . Technically a woman can refuse to receive the get as leverage. But technically I can eat with my hands and flatulate loudly in public. There's nowhere in the Shulchan Aruch that says I can't.<br />We've become so obsessed with paskening by the book we've lost the finesse of real Judaism. We permit "naval b'rshut haTorah" because the Torah never actually says it's not allowed.
